The Toledo city charter sets the dates for the mayoral and city council primaries, which occur in September.

But the charter specifies that no primary will occur for this year's special mayoral election. The new mayor will be elected from a pool of candidates in November.

And if I understand things, Toledo City Council will choose someone to fill the vacancy left by former district council member Paula Hicks-Hudson.

Council Clerk Gerald Dendinger said Mayor Hicks-Hudson holds the mayor’s seat until either she or a replacement is elected in November.

“There will be no primary, and in the Nov. 3 general election, it could be one person or 100 people running for mayor,” Mr. Dendinger said.

Ms. Hicks-Hudson said she has not thought about the November election and has not considered running.

The question of mayoral succession will get resolved in due time. Whoever wins a special election this November will serve the final two years of Mayor Collins’ term. But unlike a standard mayoral election, the special election won’t be preceded by a primary vote to narrow the field.

From the charter:

Section 12. Non-partisan primary.

Candidates for Mayor and for Council to be voted for at the regular City election under the provisions of this Charter shall be nominated at a non-partisan primary election to be held on the second Tuesday after the first Monday in September of 1967 and thereafter on the second Tuesday after the first Monday in September in such odd-numbered years as hereinafter provided.

Section 13. Nominating petitions.

The name of any elector of the City shall be placed upon the primary election ballot for nomination as a candidate for Mayor when there shall have been filed with the election authorities a petition signed by not less than seven hundred fifty (750) nor more than fifteen hundred (1500) electors of the City, and for City Council running at-large when there shall have been filed with the election authorities a petition signed by not less than two hundred fifty (250) nor more than five hundred (500) electors of the City, and for City Council running in a district when there shall have been filed with the election authorities a petition signed by not less than fifty (50) nor more than one hundred (100) electors ...

Section 15. Selection of Candidates for Mayor and for Council.

The number of candidates at the regular City election shall be the two (2) candidates for the office of Mayor receiving the highest number of votes in the primary election; for the office of member of Council at-large shall be twice the number to be elected who receive the highest number of votes in the primary election; and in addition to the foregoing, commencing with the primary election in 1993, candidates for Council from a district shall be the two (2) candidates receiving the highest number of votes within the district. In case there shall not be more than two (2) lawful candidates for Mayor, or not more than twice the number of lawful candidates for the office of member of Council, or not more than two (2) lawful candidates for member of Council from a district, to be elected at the regular City election, then in any or all such cases the full number of candidates for Mayor or for Council at such primary election shall be the candidates at the regular City election.

Section 15A. Elections to Fill Vacancies.

If there is a vacancy in the office of Mayor, or member of Council, from a district or at-large, the vacancy shall be filled first by appointment or succession to the office as specified in this Charter and filled for the unexpired term at an election for that purpose as specified below.

If there is a vacancy in the office of Mayor or Member of Council at-large, an election for the unexpired term shall be held at the next general election occurring more than ninety (90) days after the date of the vacancy. Persons desiring to become candidates for the office shall file nominating petitions as provided in this Charter with the election authorities not later than the sixtieth day before the said election. If the vacancy occurs in the year that the election for that office is already scheduled, then the person appointed shall serve until a successor is elected and qualified.

Section 26. The Council.

Vacancies in Council shall be filled by election of the remaining members of the Council of an individual qualified to serve as a member of Council in accordance with this Charter. In the event Council fails to fill such vacancy within thirty (30) days of the occurrence of any vacancy, then the Mayor shall fill such vacancy. Such individual shall serve by appointment until a successor is elected and qualified at an election as specified herein.

Section 61A. Succession to Mayor - Acting Mayor.

If the Mayor dies, resigns, is removed from office, or becomes permanently disabled from performing the duties of the office of Mayor, the Mayor shall be succeeded in office until an election of a successor as specified herein by the President of Council, who shall thereby cease to be a member of Council, and who shall hold the office of Mayor until a successor is elected and qualified. If the Mayor becomes temporarily disabled from performing the duties of the office for any cause, the President of Council shall become Acting Mayor, with all powers and duties attendant thereto which are conferred or required by this Charter.
