For more information on Outdoor Refreshment Areas, please refer to Toledo Municipal Code § 331.43.
Excerpts:
Opened container of beer or intoxicating liquor prohibited at certain premises.A person may have in the person's possession an opened container of beer or intoxicating liquor at an outdoor location within an outdoor refreshment area created under section 4301.82 of the Revised Code ...
(ORC 4301.62; Ord. 171-16. Passed 5-10-16.)
4301.62 Opened container of beer or intoxicating liquor prohibited at certain premises
4301.82 Designated outdoor refreshment areas.
I have not yet seen language that states that the police chief can suspend temporarily the ordinance at any time.
4301.82 states:
At any time, the legislative authority of a municipal corporation or township in which an outdoor refreshment area is located may, by ordinance or resolution, dissolve all or a part of the outdoor refreshment area.
That doesn't apply to the police chief.
In another thread, Mariner said :
The Chief's main job is to keep the peace. That's what he was setting out to do.
Okay. Fine.
I don't know every tiny detail of Toledo government. I'd like to see the official wording that gives this kind of power only to the Toledo police chief. Is it stated in the city charter? Where?
I'm sure that the document or the wording exists somewhere. I'd like to see the web link. Maybe it's interpreted wording.
And regarding this week's particular issue, DORA began on June 15, 2017. Did the police chief warn the businesses prior to his suspension statement? Did he consult with business owners and other city officials before announcing his suspension order?
